DAVID S. JAFFE

GENERAL OVERVIEW

For more than 32 years, David served as internal counsel to the management and members of the National Association of Home Builders on a full range of association issues, with increasing specialty in construction liability, product defects and risk management.  Key responsibilities included:

  • Coordinating NAHB involvement in complex litigation
  • Providing expert advice and strategies for reducing builder liability
  • Developing technical, legal, and business resources for members on a wide range of issues affecting the industry
  • Writing ”friend of the court” briefs
  • Speaking and representing NAHB at various industry forums and educational programs
  • Negotiating and reviewing contracts between NAHB and vendors

David authored or co-authored the following books:

    • Warranties for Builders and Remodelers (BuilderBooks.com)
    • Contracts & Liability for Builders and Remodelers (BuilderBooks.com)
    • Warranties and Disclaimers for Builders (Home Builder Press)
    • Warranties and Disclaimers for Remodelers (Home Builder Press)

and provided legal review of NAHB’s Residential Construction Performance Guidelines for Professional Builders and Remodelers, anddrafted the updated version ofNAHB’s residential construction contract forms.

Prior to joining NAHB, David worked for the nation’s oldest and largest legal research firm where he provided customized research and analysis and prepared legal memoranda, trial and appellate briefs for attorneys nationwide.  He also worked in a Boston law firm where he practiced general civil trial practice, probate, and real estate law.
