GENERAL OVERVIEW

Mr. Smits has thirty-five years experience representing clients in civil litigation, both individually and on behalf of their insurers. A significant portion of this experience has related to construction issues, including duties and responsibilities under the contract documents and claims of defect in design, workmanship, materials, applications and procedures. The subject matter of these cases has ranged from subterranean ground preparation for airport runway or other structure to roof failure on commercial buildings. This practice has necessitated close work with specialists in various disciplines involved and understanding of code requirements and standard recommendations.

Service to Bar

With an early interest in mediation as a tool for litigators, Bill chaired the ADR Committee of the Iowa State Bar Association Litigation Section. This Committee, in conjunction with the Polk County Mediation Project, organized and implemented the Iowa Statewide Mediation Program in 1994, training lawyers across the state as mediators.

As recognition of Alternative Dispute Resolution methods grew, a separate Alternative Dispute Resolution Section of the Iowa State Bar Association was organized, of which Bill was the first chair.
